Problem with legend marker

Hello, I have found again a problem which can not be eliminated easily or I'm just blind again.

In my picture is my chart shown which I create by Spire now I have the problem that I need the marker in the legend but in the error bar should this if not be there is there a solution?

If its really broken then ill have to contact the seller and have them send me some new parts...warranty is still on.
